DMCA Policy

Effective Date: September 7, 2024

This Digital Millennium Copyright Act (“DMCA”) Policy applies to the Nautical Property Management website located at https://nauticalpm.com and any other websites or applications associated with Nautical Property Management (collectively, the “Site”).

1. Copyright Infringement Notification

If you believe that content available on or through our Site infringes one or more of your copyrights, you may submit a notification of such infringement to our Designated Copyright Agent as set forth below. Your notification must comply with the requirements of the DMCA (see 17 U.S.C. § 512(c)(3) for details). You may also seek legal advice before filing a DMCA notification.

2. Filing a Notification

To file a DMCA notification, you must provide the following information in writing:

  • An electronic or physical signature of the person authorized to act on behalf of the copyright owner.
  • A description of the copyrighted work that you claim has been infringed, or, if multiple works are covered by this notification, you may provide a representative list of such works.
  • A description of the material that you claim is infringing and that you request be removed or access to which is disabled, along with the URL or other specific location of such material.
  • Your address, telephone number, and email address.
  • A statement by you that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

3. Counter-Notification

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the material, you may submit a counter-notification to the Designated Copyright Agent. Your counter-notification must comply with the requirements of the DMCA (see 17 U.S.C. § 512(g)(3) for details).

4. Filing a Counter-Notification

To file a counter-notification, you must provide the following information in writing:

  • Your physical or electronic signature.
  • A description of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  • A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal court in the district in which your address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

5. Designated Copyright Agent

If you believe that content on our site infringes your copyright, you should send a notification to our Designated Copyright Agent, who is responsible for receiving and processing notices of claimed infringement under the DMCA.

6. Repeat Infringers

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
